A Stock letter to send to your MP regarding Rape Law in the UK
Some of you following me may remember that I posted a little while back about wanting to start a campaign to see the rape laws in the UK broadened to include victims who currently are being failed, via writing to MPs to start, and then seeing what can be done next.
Well, I’ve written the letter, and would like to share it so other UK people on Tumblr would be able to make use of it to contact their MP about changing rape laws in the UK.
I would appreciate people reblogging this as much as possible to help get the word out, and get more people contacting their MP, expressing their feelings about how bad our Rape laws are.
Here’s the letter:
Dear [MP Name],
I am writing to you today in regards to something I see as extremely important, and a huge failing of a current law.
(a) he intentionally penetrates the vagina, anus or mouth of another person (B) with his penis,(b) B does not consent to the penetration, and(c) A does not reasonably believe that B consents.
I am sure you are aware that, currently the offence of Rape is dealt with in Section one of the Sexual Offences Act 2003, and Section One details the offence as such:
1-(1) A person (A) commits an offence if—
As you can see, this law only covers instances of Rape, where the perpetrator has a penis, meaning that currently, only Men are capable of being charged and tried for the crime. I find this horrific, as it not only sets up a system whereby men are perpetually found to be the only perpetrators of Rape, but it prevents Victims who were raped by women from ever seeing their rapists charged with the correct crime.
It means that the Government, and the Law is telling people unless you were raped by a man, using his penis - you weren’t raped. It is truly shocking, that in this day and age we continue to have such an outdated definition of rape.
Rape should not be defined solely as a man, penetrating without consent as it results in many victims not being able to see their attacker face true justice in the courts, not to mention has the extremely ill effect of causing the likelihood of a victim to report their rape to the police to fall, as their rape won’t be treated in the manner it should be, it will instead be treated merely as sexual assault, instead of Rape.
It also results in public perception of instances of rape to be skewed - resulting in victims who were not raped by a man with his penis, to not be considered rape victims, and for their rape to not be considered as such. It is something that is most easily seen through reports of men being raped by women via envelopment - we see reporters and the public regarding the rape as something funny, something to be mocked, which only furthers the likelihood that victims of rapes such as this are far less likely to come forward and report their rape.
I feel that the Legal definition of Rape in the UK , should be expanded to include instances of Forced Envelopment - whereby a woman will force a man’s penis to enter her without consent, as well as instances of rape where an object other than a penis is used, including other body parts, as well as objects.
To include these in the definition of rape, would mean that victims currently being failed by the laws would see their rapist charged with the correct crime, and give them the smallest modicum of respect they deserve, after being made to suffer a harrowing experience.
